Januar 1916 legte Arnold Sommerfeld der Bayerischen Akademie der Wissenschaften zwei Abhandlungen im Umfang von 75 Druckseiten vor, mit denen er das Bohrsche Atommodell aus dem Jahr 1913 zur Bohr-Sommerfeldschen Atomtheorie erweiterte. In Sommerfelds Gesammelten Schriften findet sich nur die im Juli 1916 von Sommerfeld in den Annalen der Physik eingereichte Publikation darüber. "Meine Spektrallinien sind endlich in der Akademie in’s Unreine gedruckt. In den Annalen werden sie in geläuterter Form erscheinen", so (...) hatte Sommerfeld am 10. Februar 1916 dem Herausgeber der Annalen der Physik diese Publikation angekündigt. Aus wissenschaftshistorischer Sicht sind für die Erweiterung der Bohrschen Atomtheorie jedoch gerade die vor dem Läuterungsprozess publizierten Akademieabhandlungen von besonderem Interesse. In July 1907 the Holy Office issued the decree „Lamentabili“, which has been regarded as the first important formulation of the antimodernism prevalent under Pope Pius X. This essay offers the first reconstruction of the internal history of „Lamentabili“ as a document, based on the archival material in the Roman Congregation for the Doctrine of the Faith. The history behind Lamentabili goes back to the censuring of Loisy's main works in 1903. The long and difficult process of drafting and discussing (...) the propositions of „Lamentabili“ reveals divergent opinions about Loisy and the entire „modernist“ problem within the Holy Office. Lamentabili bears traces of attenuation and compromise, and it seems probable that the necessity of drafting the papal Encylica „Pascendi“ against the errors of the „Modernists“ sprang from the dissatisfaction of leading antimodernists with the formalized and tedious process of conducting discussions within the Roman Inquisition. One issue of dispute between methodological individualists and methodological holists is whether holist explanations are dispensable in the sense that individualist explanations are able to do their explanatory job. Methodological individualists say they are, whereas methodological holists deny this. In the first part of the paper, I discuss Elder-Vass’ version of an influential argument in support of methodological holism, the argument from emergence. I argue that methodological individualists should reject it: The argument relies on a distinction between individualist and holist (...) explanations that they find unacceptable and Elder-Vass’ reasons in support of his way of drawing this distinction are not good ones. In the second part, I examine what, if anything, would be good reasons in support of a particular way of differentiating between individualist and holist explanations. I propose that a good reason is one which shows, in an acceptable manner, that the distinction, drawn in the same way in all contexts, is useful from the perspective of offering explanations of the social world. I show that if this criterion is adopted, it will result in a fruitful reorientation of the whole debate between methodological individualists and methodological holists. (shrink)

In recent years, scholars of Jewish politics have invested political hopes in the revival of “political imagination.” If only we could recapture some of the imaginativeness that early Zionists displayed when wrestling with questions of regime design, it is argued, we might be able to advance more compelling “solutions” to the Israeli-Palestinian conflict. Yet how does one cultivate political imagination? Curiously, scholars who rehearse the catalogue of regimes that Jews have historically entertained seldom pose this question. In this Article, I (...) revisit a historical episode—the appropriation of diasporic historical narratives by Zionists in mandatory Palestine—in an effort to cultivate a richer political imaginary. I analyze the labor Zionist deployment of Simon Dubnow’s influential master narrative, focusing on a 1926 speech in which David Ben Gurion depicts the autonomist regime that he advocates as a variation upon diasporic political practices. On my reading, this episode illustrates the dilemmas that confront thinkers who invest political hopes in regime design. To realize the promise that new political configurations may emerge from reflections upon Jewish history, I argue, we must develop a new account of political agency, once foundational assumptions of the nation-state have been suspended. In this paper, I examine a heretofore ignored critic of Descartes on the heterogeneity problem: Anton Wilhelm Amo. Looking at Amo’s critique of Descartes reveals a very clear case of a thinker who attempts to offer a causal system that is not a solution to the mind-body problem, but rather that transcends it. The focus of my discussion is Amo’s 1734 dissertation: The Apathy [ἀπάθεια] of the Human Mind or The Absence of Sensation and the Faculty of Sense in the (...) Human Mind and their Presence in our Organic and Living Body. Amo’s discussion of the interaction, or lack thereof, of the mind and body hinges on the essential feature he identifies for the human mind—apathy, that is, impassivity. In this work, Amo engages explicitly with Descartes’s writing, which allows us to more precisely see the nature of his agreement and disagreement with the Cartesian metaphysics of mind. I proceed by treating Amo’s five stated criteria for spirit-hood which, in turn, reveal the kinds of causal connections that are possible for embodied spirits on his view. My aim is threefold: To lay out what I take to be Amo’s view of and arguments for the five criteria he takes to be required for a substance to be spirit. To locate Amo’s agreement and disagreement with Descartes. To suggest that Amo’s view on mind-body interaction involves a kind of occasional causation. (shrink)

This paper answers the title question, “Yes,” on both counts. The first part of the paper argues that modern liberals are socialists, and the second part argues that they are also social democrats. The main idea behind the first argument is that the state has effectively taken control of the incidents of ownership through its taxation, spending, and regulatory policies. The main idea behind the second argument is that the institutions of social democracy are replicated by the institutions favored by (...) modern American liberalism. Specifically, the takeover of the American healthcare system, Social Security, employers' mandatory contributions to unemployment insurance, and workers' compensation insurance replicate the institutions of social democracy. The problem of theorizing privacy moves on two levels, the first consisting of an inadequate conceptual vocabulary and the second consisting of an inadequate institutional grammar. Privacy rights are supposed to protect individual subjects, and so conventional ways of understanding privacy are subject-centered, but subject-centered approaches to theorizing privacy also wrestle with deeply embedded contradictions. And privacy’s most enduring institutional failure modes flow from its insistence on placing the individual and individualized control at the center. Strategies for rescuing privacy from (...) irrelevance involve inverting both established ways of talking about privacy rights and established conventions for designing institutions to protect them. In terms of theory, turning privacy inside out entails focusing on the conditions that are needed to produce sufficiently private and privacy-valuing subjects. Within the political economy of informational capitalism, commercial surveillance practices are tools for resource extraction. That process requires an enabling legal construct, which this essay identifies and explores. Contemporary practices of personal information processing constitute a new type of public domain—a repository of raw materials that are there for the taking and that are framed as inputs to particular types of productive activity. As a legal construct, the biopolitical public domain shapes practices of appropriation and use of personal information in (...) two complementary and interrelated ways. First, it constitutes personal information as available and potentially valuable: as a pool of materials that may be freely appropriated as inputs to economic production. That framing supports the reorganization of sociotechnical activity in ways directed toward extraction and appropriation. Second, the biopolitical public domain constitutes the personal information harvested within networked information environments as raw. That framing creates the backdrop for culturally situated techniques of knowledge production and for the logic that designates those techniques as sites of legal privilege. (shrink)

The Mental Capacity Act 2005 has stipulated that in England and Wales the ethical implications of carrying out research with people who are unable to consent must be considered alongside the ethical implications of excluding them from research altogether. This paper describes the methods that were used to enable people with severe and profound intellectual disabilities, who lacked capacity, to participate in a study that examined their experience of receiving intimate care. The safeguards that were put in place to protect (...) the rights and well-being of participants are described, and it is argued that the approaches used in this study met the requirements set out in the Mental Capacity Act 2005. Although this paper is based on research involving people with intellectual disabilities, it has implications for research involving other groups who may also lack capacity to consent, including people with mental health problems, head injuries and dementia. A thoughtful meditation on the role of meaning and purpose in the development of technology.

In this chapter, I make three main points. First, I argue that, on Locke’s view, the power of human freedom is good because it allows us to be determined by the goods we have chosen for ourselves. Under ideal conditions, this power allows intellectual beings to attain happiness. There is, however, ample evidence that many intellectual beings are unhappy. This observation leads me to my second point. For Locke, bad choices are no less freely made than good ones. This is (...) because bad decisions come from bad judgments about the intrinsic value of things, not from weakness of will. I next pose the question of how Locke understands the mechanism of our evaluation of the intrinsic value of things. I advance my third point by noting that while Locke thinks that many of our inclinations are engrained in childhood, it is possible for even the most inveterate sinners to change the way they perceive value, thereby changing their behavior. Beyond the cultural gaps between researcher and subject, the Latin American people have their own perspectives about responsible conduct of research formed by sociopolitical thought and familial and community identity, which may be overlooked or ignored by the U.S. and other foreign nations. Just as the Havasupai Tribe in Arizona have challenged us to think about the role of culture and the need for improved regulations and practices in conducting research within the United States, through past abuses in human experimentation and the emergence of discourse between our Latin American neighbors, similar challenges confront us. Park argues that there are surprisingly pervasive and stubborn myths about diversity on college and university campuses, and that these myths obscure the notable significance and admirable effects that diversity has had on campus life. _ Based on her analysis of extensive research and data about contemporary students and campuses, Park counters these myths and explores their problematic origins. Among the major myths that (...) she addresses are charges of pervasive self-segregation, arguments that affirmative action in college admissions has run its course and become counterproductive, related arguments that Asian Americans are poorly served by affirmative action policies, and suggestions that programs and policies meant to promote diversity have failed to address class-based disadvantages. In the course of responding to these myths, Park presents a far more positive and nuanced portrait of diversity and its place on American college campuses.
